they shouldn't, and last one I looked at, you couldn't. 

 Unfortunately that wouldn't matter though, as it's hand programmable and I'm pretty sure the rule was worded that if it's capable of transmitting, and is hand programmable, it's deemed illegal and you get fined (regardless of actually transmitting or not)
