Hi Bob

No he cannot unless it's a public frequency like the personal radio service
that operates in the 400 mhz band The Frequency that he picks would be
licensed to a company and they will be paying a fee for using that
frequency he can't just program that into his radio and start transmitting
on it that would be an illegal that would be like me buying a radio then
say I want this frequency what's happens to be a frequency used by the
police programming it in and transmitting on that frequency that would be
extremely illegal I'm not 100% sure if this is correct but I'm 99.95% sure
